a). Conclusion of contract

• A final and binding contract has been concluded between you and www.pepejeans.in when your order has been confirmed by www.pepejeans.in, www.pepejeans.in will send an order confirmation to you by email when the order has been confirmed and shipped. The order receipt received immediately after placing the order does not constitute an order confirmation.
• You are only allowed to purchase products in the www.pepejeans.in online shop if you are a private consumer, i.e. not a business customer.

b). Prices, taxes and delivery

• All prices are stated inclusive of GST and other taxes. The applicable price is the one stated in the here in respect of the relevant product on the date of placing of the order.

Furthermore, www.pepejeans.in reserves the right to amend any prices, taxes and/or other costs stated on this website at any time, e.g. due to changes in GST rates or other public fees and charges, increased costs or as a result of the general development in retail prices.
• For those total orders which are less than Rs 1000/-, www.pepejeans.in reserves right to levy a delivery charge of Rs 100/- (Rupees Hundred Only).

c). Payment Services

• While making Payments via any of the electronic prepaid payment methods available on the Website, www.pepejeans.in will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
• • Lack of Authorization for any transaction/s, or
• • Exceeding the preset limit mutually agreed by You and the bank/s, or
• • Any payment issues arising out of the transaction, or
• • Non availability of funds in the relevant account/ wallet, or
• • Decline of transaction for any other reason/s.
• All payments made against the purchases on the Website by You shall be in Indian Rupees only and either by cash on demand or via payment methods issued under Indian laws (i.e. credit cards, debit cards, bank accounts, wallets etc. issued by banks registered and licensed in India). The Website will not facilitate any transaction with respect to any other form of currency or payment method.
• If You purchase products from www. Pepejeans.in for an amount equal to or above INR 200,000 (Indian Rupees Two Lakhs only), You will be required to share a scanned copy of Your PAN card as required under applicable law, within four (4) days from the date of making such purchase/ placing order, failing which, the order placed shall be cancelled. If there is any discrepancy between Your name as registered on the Website and Your name on the PAN Card, Your order shall be cancelled

d). Delivery

• www.pepejeans.in will usually accept and ship the order within 2-3 working days. The usual time of delivery from the time of dispatching the order confirmation is 4-7 working days.
• www.pepejeans.in reserves the right to prevent persons from shopping via this website www.pepejeans.in is not obliged to deliver goods which are out of stock.
• www.pepejeans.in reserves the right to cancel any orders due to internal reasons or change in policy subsequent refund will be made for any amount paid for such orders.

e). Right of withdrawal

• You have a right to withdraw from the contract entered into without giving any reasons.

The cooling-off period is 15 days; this period is calculated from the date on which you received the goods.

If the last date where goods can be returned is a public and/or national holiday the deadline will expire on the following working day. The deadline has been observed if you send a message that you want to exercise the right of withdrawal before the deadline expires.

If you want to withdraw from the contract, please send an unambiguous statement to us at customercare@pepejeans.in that you want to withdraw from this contract. In your statement please indicate your name, physical address, phone number, email address, order number and which products you wish to return. In case your goods have been returned to us without a statement that you exercise your right of withdrawal, we will regard the return of the products as a withdrawal from the contract.

If you exercise your right to withdraw from the contract, we will refund all payments received from you, without unnecessary delay and in any event no later than 30 days after the date when we received your request to withdraw from this contract. Refunds will be credited to your original method of payment unless you have explicitly accepted otherwise. In any event you will not be charged with any fees as a result of the repayment.

For all Cash on Delivery (COD) orders, if any refund arises, such refunds will be generated by way of E-Gift voucher which will be redeemable on www.pepejeans.in

We may withhold the repayment until we have received the goods or until you have submitted documentation that the goods have been returned, as may be appropriate.

You must return the goods to us without undue delay and no later than 15 days after the date when you have informed us that you want to withdraw from the contract. Withdrawal from the contract will be deemed in due time if, before expiry of the 15-day period, you have handed over the goods. To retain proof that you have withdrawn from the contract in due time, you should keep the receipt or return tracking number stating that you have handed over the goods.

In order to return any product sold through the Website, You are required to comply with the below mentioned conditions, viz.:

a) www.pepejeans.in should be notified of the receipt of a damaged or defective product or if the product is significantly different from what was purchased or the package delivered is missing one or more products, within period mentioned in the returns policy.

b) Products should be returned unused, in their original packaging along with the original price tags, labels, packing, barcodes, and invoices. If any product is returned without the essentials, the product shall not be accepted for return and shall be sent back to you, Footwear returned without an outer box will not be eligible for a refund and will be sent back to the original order address.

c) The returned products are subject to verification and quality checks by www.pepejeans.in in order to determine the legitimacy of the complaint or return.

d) You are only liable for any impairment of the value of the goods caused by other handling than what is necessary to determine the nature, quality and function of the Products

e) Return of or refund for purchased Products shall not be entertained by www.pepejeans.in if :

• i) the Product has been used for reasons apart from checking fit and comfort. If www.pepejeans.in is satisfied that the Product has been used for reasons apart from checking fit and comfort, www.pepejeans.in shall reserve the right to reject the return of the Product;
• ii) the Product has been washed / perfumed on the product.
• iii) original price tags, labels, packing, barcodes, and invoices have been damaged or discarded by you;

Cash on delivery refunds will be done through E-Gift voucher of such equivalent refund value, which will be redeemable on www.pepejeans.in,

Refund shall be in Indian Rupees only and shall be equivalent to the sale price of the relevant product received in Indian Rupees. There shall be no refund of delivery charges or gift wrapping charges.

While the Website may provide a feature where Users may be permitted to share reviews/ratings in relation to the products purchased from www.pepejeans.in does not endorse any user submission or any opinion, recommendation, or advice expressed therein. www.pepejeans.in reserves the right to moderate all user reviews and submissions. www.pepejeans.in expressly disclaims any and all liability in connection with User submissions. www.pepejeans.in will remove User submissions, without prior notice, if notified that such content or user submission infringes on another's intellectual property rights.

You will be required to enter a valid phone number while placing an order on the Website. By registering your phone number with us, your consent to be contacted by Us or our third party service providers via phone calls, SMS notifications, mobile applications and/or any other electronic mode of communication in case of any order or shipment or delivery related updates. www.pepejeans.in 's liability for any and all claims is limited to an amount equal to the price of the good purchased by you.

www.pepejeans.in assumes product liability vis-a-vis you under applicable law.

You shall indemnify and hold harmless www.pepejeans.in and Pepe Jeans India Ltd, its owners, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, actions, losses, liabilities including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of these Terms and Conditions, and other policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
